It's a stand off.
Rising Sun Mayor Bob Fisher said when the town commissioners rescind Resolution 2012-03 (and 2013-02) he will drop the lawsuit which is currently awaiting a hearing date at the Court of Appeals in Annapolis.
Fisher contends that these resolutions decreased the duties of the mayor and transferred them to the town administrator. Resolution 2012-03 was passed in 2012, two weeks after Fisher took office. It was introduced the night he took office. Resolution 2013-02 is a duplicate of the 2012-03. It was passed after questions came up in court about whether it was passed properly a year prior. The only current town commissioner on the board now who voted for these two resolutions is Commissioner Travis Marion. "When those two pieces of legislation are rescinded, the lawsuit will be dropped," said Fisher. "As of the last meeting (August 27), I am waiting for them to make the first move."
On the other hand, Town Commissioner George Walker said he will vote to rescind 2012-03 after Fisher drops the lawsuit. But Walker pointed out he is speaking on his own behalf and can't speak for the remaining commissioners.
"I would vote to repeal it, if we didn't have a lawsuit," said Walker. "It takes some duties of the mayor and commissioners and gives it to the town administrator. But the power still remains with the commissioners. The town administrator has enough to do already."
Walker said the town commissioners do struggle with getting along with Mayor Fisher. "When it comes to the mayor, if you disagree with him, you are his enemy. And that's not the way it should be. The commissioners get along well and we disagree. It doesn't make us enemies," said Walker.
Walker said he won't suggest repealing the resolutions as long as the lawsuit is pending.
Commissioner Bernie Chiominto shared his view. "I don't think he (Fisher) is going to drop the lawsuit. It's been over a year and a lot of money has been spent on it," he said. "How do we recoup our funds. It's a shame the budget had $150,000 for lawsuits in it. He (Fisher) has already been denied twice...He didn't lose any power. He wants to be the decision maker of everything."
